Grubhub - Guidelines for Law Enforcement Authorities

These guidelines offer law enforcement officials a procedure and set of best practices for working with Grubhub. Private parties, including civil litigants and criminal defendants, should consult our Guidelines for Third Party Data Requests & Service of Legal Documents.

At Grubhub, we appreciate the hard work law enforcement provides to our company and the communities we connect. We believe it is important to assist law enforcement authorities with legitimate investigations while also protecting the privacy of those who use the Grubhub platform. It is worth noting that in some cases, law enforcement may find that a diner, delivery partner or restaurant who has filed a complaint can directly provide the best evidence.

We will respond to records requests in accordance with Grubhub’s Terms of Use, Privacy Policy, oother relevant policies, and applicable law. These are merely guidelines and this information may change at any time.

Law Enforcement Requests

We generally require a search warrant, subpoena or valid court order issued in connection with an official criminal investigation to compel the disclosure of basic information. The type of process we require depends on the nature of the request. For most basic information requests, we require a subpoena, court order, or search warrant. For requests for precise geolocation (GPS) data, we generally require a search warrant.

We may make exceptions to these requirements for emergency and exigent requests (as described below), where a user has provided his or her consent, or where other legal or regulatory standards apply.

Form of Requests

As of January 10, 2024 and except in the case of an Emergency Disclosure Request as outlined below, law enforcement officials will be required to serve search warrants, subpoenas, and/or valid court orders on Grubhub via our registered agent for service of process. Please consult the Secretary of State’s website for your state to find the name and contact information for Grubhub’s current registered agent. Our registered agent will accept service only if the entity to whom the document is directed matches the name of the entity registered with the Secretary of State. Our acceptance of legal process does not waive any legal objections Grubhub may have and may raise in response to the request. Our registered agent is the only channel authorized to accept service of legal documents for Grubhub Holdings Inc. and its affiliates. As such, all subpoenas sent to Grubhub Holdings Inc. via email or sent to a Grubhub office will be rejected for improper service.

Law enforcement should address requests to Grubhub at the address of our current registered agent for service of process: Attention General Counsel.

Note: Please allow Grubhub reasonable time to respond to the request. Due to the high volume of requests we receive, please allow Grubhub at least 14 calendar days from the date of service to respond.

What to Include in Your Request

Clear grounds for the legal basis for the request.

  • Detailed specifics on the information requested and its relationship to your investigation. We will be unable to process overly broad or vague requests that do not identify the specific information sought.
  • All known email address(es), names or alias(es), known physical address(es), telephone number(s), and/or credit card account information of the subject for whom you are seeking information.
  • Please be advised that delivery partners are not employees of Grubhub, but rather independent third-parties. Therefore, we do not verify or provide any employment history or personnel files for these individuals.
  • The name of the issuing authority, the badge/ID number of the responsible agent or officer, an email address from a law-enforcement domain, and a direct contact number for the responsible agent or officer.

Emergency Disclosure Requests

Emergency requests are situations that involve an immediate risk of death or serious bodily injury or cases of verifiable time-sensitive investigations. In these situations, requestors must submit an Emergency Disclosure Request to LER@grubhub.com. We review these requests on a case-by-case basis.

Emergency Disclosure Requests must include all of the following:

  • “Emergency Disclosure Request” identified in the subject line of the request;
  • Identity of the person in immediate risk of physical harm;
  • Describe in detail the nature of the emergency or urgency and why the information requested is necessary to prevent the emergency;
  • All other available details or context regarding the particular circumstances.

We may respond with some or all requested information when we have a good faith belief that doing so may protect diners, delivery partners, restaurants, employees, or other people, or when that information may otherwise assist with an exigent investigation. We may still require law enforcement to obtain appropriate legal process for any initial or additional disclosure.

Notice to Subject of Request

Unless otherwise prohibited by law, Grubhub may notify diners, restaurants and delivery partners of law enforcement requests for their information before disclosure. Law enforcement officials seeking non-disclosure of legal process should provide an appropriate court order, other information establishing that notice is prohibited or would otherwise pose a risk to public safety.
